二、改弦更张的波斯纳?

Judge Posner evidently writes the way other men breathe. Ihave to say that the prose in this book often reads as if it were written, ormaybe dictated, in a great hurry. There is some unnecessary repetition, andmany paragraphs spend more time than they should on digressions that seem tohave occurred to the author in mid-thought. If not exactly chiseled, the proseis nevertheless lively, readable, and plainspoken. The haste may have beenjustified by the pace of the events he aims to describe and explain. Posner hasan extraordinarily sharp mind, and what I take to be a lawyerly skill inargument. But I also have to say that, in some respects, his grasp of economicideas is precarious. In his book on public intellectuals, Posner blames thedecline of the species on the universities and their encouragement ofspecialization. I may be acting out that conflict. Remember that evenhairsplitting is not so bad if what is inside the hair turns out to beimportant.

波斯纳法官大人,显然说出了人们的心里话。可我不得不说,这本书的文句读来,常常让人觉得是匆匆写就。或者是口述?有几处不必要的重复;有许多段落枝节芜杂,作者似还处于思考的半途。若不做切实的删削,文句就死气沉沉、艰涩难读、佶屈聱牙。事件描述,事件解释,时快时慢,绝不整齐,此亦为行文匆促的佐证。波斯纳思维敏捷,我以此为讼师辩论技巧所致。但是,我必须说,在某些方面,他对经济学概念的掌握,却大成问题。波斯纳,在一本讨论“公共知识分子”的书里,他谴责大学种类的下降,谴责大学太过鼓励专业化。哈,我可能就是这种矛盾的典型。我想说,如果在理发业里,如果人们认为“用梳子梳个分头”,也是很重要的,那么,“分头业”也不算是很差的专业化工作。

The plainspokenness I mentioned is what makes this book anevent. There is no doubt that Posner has been an independent thinker, never apassive follower of a party line. Neither is there any doubt that his independentthoughts have usually led him to a position well to the right of the politicaleconomy spectrum. The Seventh Circuit is based in Chicago,and Posner has taught at the University of Chicago. Much of histhought exhibits an affinity to Chicagoschool economics: libertarian, monetarist, sensitive to even small matters ofeconomic efficiency, dismissive of large matters of equity, and thereforeprotective of property rights even at the expense of larger and softer"human" rights.

But not this time, at least not at one central point, themain point of this book. Here is one of several statements he makes:

Some conservatives believe that the depression is theresult of unwise government policies. I believe it is a market failure. The government'smyopia, passivity, and blunders played a critical role in allowing therecession to balloon into a depression, and so have several fortuitous factors.But without any government regulation of the financial industry, the economywould still, in all likelihood, be in a depression; what we have learned fromthe depression has shown that we need a more active and intelligent governmentto keep our model of a capitalist economy from running off the rails. Themovement to deregulate the financial industry went too far by exaggerating theresilience—the self-healing powers—of laissez-faire capitalism.

某些保守派人士,确信此次萧条,为政府不智政策之结果。政府之短视、之消极、之愚蠢,使衰退扩张为萧条,此为最关键处。是以尚有可转寰之处。但是,若无政府对金融业之监管,经济亦会处于萧条之中,且,此种概率亦不小。从萧条之中,我们的教训为:需要政府积极,需要政府聪明,以使资本主义经济不致脱轨。政府放松金融业之监管,甚之极矣!期之以放任自由之资本主义的弹力,期之以放任自由之资本主义的自愈能力,甚之极矣!
